DMCA Policy
Dbd Twitter ("we", "us", "our") is committed to respecting the intellectual property rights of others and expects its users to do the same. In compliance with the Digital Millennium Copyright Act ("DMCA"), we respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.
As a service provider, Dbd Twitter does not proactively monitor content for copyright infringement. However, upon receiving a valid DMCA takedown notice, we will promptly remove or disable access to the infringing material and take appropriate action against repeat infringers, which may include termination of their account.
Filing a DMCA Notice of Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on Dbd Twitter infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (please consult your legal counsel or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Dbd Twitter to locate the material (e.g., specific URLs of the allegedly infringing content).
- Information reasonably sufficient to permit Dbd Twitter to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Failure to comply with all of the requirements of Section 512(c)(3) of the DMCA may result in your DMCA notice not being effective.
DMCA Counter-Notification
If you believe that material you posted on Dbd Twitter was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Pursuant to Sections 512(g)(2) and (3) of the DMCA, your counter-notification must include substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which Dbd Twitter may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receipt of a valid counter-notification, Dbd Twitter will promptly provide the complaining party with a copy of the counter-notification and inform them that Dbd Twitter will replace the removed material or cease disabling access to it within 10 business days. Unless the copyright owner files an action seeking a court order against you within 10 to 14 business days of receiving the counter-notification, the removed material may be replaced, or access to it restored.
